Kardashian Beauty Not Approved by Sisters

Say it ain’t so. The Kardashian sisters are denying a fierce look?

Kourtney, Kim and Khloé are attending, with momager Kris Jenner in tow, various legal proceedings to determine the fate of Kardashian Beauty’s new five-item Fierce Collection. The sisters are claiming they never approved the new line of beauty products.

On Wednesday, they accused Hillair Capital Management and its members Neal Kaufman and Sean McAvoy of trademark infringement. Investors of Haven Beauty, Hillair allegedly used the likeness of the Kardashian brand without proper permission on both the merchandising and a virtual app.

The sisters’ official complaint reads, “The defendants launched the Fierce line that had been specifically disapproved by the Kardashians. …As such, Hillair, Kaufman, and McAvoy are all a moving, active and conscious force behind the trademark infringement.”

The Kardashians gave notice of the termination of their license agreement for Kardashian Beauty prior to the products’ release on kbeauty.com, adding a certain level of validity to their infringement claims.

The opposing parties seem to be at a stalemate as Hillair refuses to pay the Kardashian sisters their royalties until a lawsuit HIllair filed in March is resolved. Hillair claims the Kardashians insufficiently supported the company and caused damage towards the brand. Asking for compensation of $180 million, the suit was sent into arbitration and it seems Hillair is still holding onto hopes of its payout.

The Kardashian’s legal counsel, Todd Wilson, hoped to settle the combating lawsuits before the brand was publicly defiled, however, Hillair removed themselves from the legal discussions.

Haven Beauty’s chief financial officer, Jeanene Morgan, reportedly reached out to Wilson in May to approve the Fierce Collection. The Kardashian team responded that they would “not approve anything, or consider approving anything until Haven/Hillair is no longer in breach of its obligations under contract.”

Essentially, someone’s gotta give. Either the sisters give in, or Hillair pays up.

Well, Hillair was a tad impatient as they continued to produce the Fierce Collection even after the squabbles, adding the collection to the YouCam app for virtual makeup try-on and purchasing. The collection is still set to hit Ulta Beauty stores next month.
